1. Each person wishing to bid (henceforth referred to as the “bidder”) shall give his or her name and place of abode in writing prior to the start of the auction.
2. The highest Bidder for any lot shall be the Purchaser, should any dispute arise between 2 or more Bidders the lot may be put up again at the highest undisputed bidding and resold or the Auctioneers may determine the dispute at their election. Their decision is final and conclusive.
3. Each Purchaser shall pay the full amount owed for purchases at the close of the sale, or if required, the whole or portion of the purchase money as the Auctioneers may determine during the course of the Sale.
4. The fall of the Auctioneer’s hammer constitutes a legally binding contract between the Purchaser and the Auctioneer.
5. No person at any bidding shall bid less than the sum stated by the Auctioneers at the time of selling nor shall any bidding be retracted.
6. The Auctioneers have described the lots to the best of their ability and belief from the information provided by the Vendor. The Vendor who supplies such statements is alone responsible for any error or misstatement which there may be.
7. No lot/s shall be removed from the premises until paid for, but each and every lot shall immediately at the fall of the hammer be considered as, and remain to be in every respect at the absolute risk of the perspective Purchaser. All goods sold remain the property of the Auctioneers until the purchase price has been paid in full. The purchaser will remain a bailee only until payment is made.
8. The lots are sold as seen with all faults, imperfections and errors of description. Neither the Auctioneers nor the Vendor being responsible for the current description, genuineness or authenticity of any fault or defect in any lot, and giving no condition, warranty or undertaking in those regards whatever, whether by law, statute, custom trade usage or otherwise save where such undertaking is required by law to be given. The Purchaser/s hereby agree that they have by reason of his or their inspection and investigation of the lot satisfied himself or themselves of the accuracy of any description or other statement whatsoever given or made in connection with the sale, and the state of, nature and condition of said lot.
9. In as much as the Auctioneers act only as agents for the Vendor, they shall not be held personally liable for any default on the part of either Vendor or Purchaser/s.
10. No legal obligation on the Auctioneers or their employees will be imposed to take charge of any lots after the sale or to forward them to their destination.
11. In all cases of transfer the original Purchaser shall be held responsible for the purchase money.
12. The Auctioneers reserve the right of refusing any bidding they may deem it advisable to decline.
13. Purchasers are requested to pay for their lots in full and collect a receipt from the Auctioneers. Any issues or errors in either the accounts or the items delivered to the Purchaser for collection must be addressed prior to leaving the place of sale as the Auctioneers cannot themselves be held responsible for any errors in accounts or deliveries unless they are notified of the errors on the day.
14. The Auctioneers will not accept any lot that includes more than one cockerel and the Auctioneers reserve the right to limit the number of single cockerel lots per Sale.
15. The Auctioneers reserve the right to withdrawal any lot where the animal is deemed to be in ill health, under undue stress or deemed unfit for sale.
16. All entry fees paid for lots are non-refundable.
17. The Vendor is responsible for ensuring that their lot has a water container and a continuous water supply throughout the Sale until ownership has been transferred to the Purchaser upon full payment for the lot by said Purchaser.
18. The Vendor is responsible for the removal of any unsold lots at the end of the Sale. Vendors will not be paid by the Auctioneers until their unsold lots have been removed from the auction venue. If any unsold lots are left at the auction venue at the end of the Sale, the Vendor will be liable to pay £10 per pen as a fine for any costs incurred in the disposal of the lots and refused entry to future sales.
19. Vendors who have a payout of more than £200 will not receive payment until the end of the sale and all lots sold are paid and collected for.
20. The sale of any unsold lots after the end of the auction is arranged by the Auctioneers’ office. Any Vendor and Purchaser/s found to be completing transactions on unsold lots without informing the Auctioneers will be expelled from future Sales.
21. Lots must not be collected until the end of the auction. Both Vendors and Purchasers must provide proof of ownership of the lot, which can be obtained from the Auctioneers’ office, to the Auctioneers’ stewards who will deliver the lots to the Vendor/Purchaser at the entrance of the sale room.
22. The Auctioneers’ stewards will be the only persons who will be allowed to open cages/boxes and transfer lots from the sale room on the day of the Sale.
23. Any Buyers leaving commission bids will be required to show proof of ID and details of a Debt/Credit card.
24. By entering lots into the Auction and/or entering the auction premises on Sale days; Vendors, Bidders and Purchasers confirm that they have read the Terms and Conditions and agree to comply with the rules set out within them. Failure to abide by the Auctioneers Terms and Conditions could result in being rejected from the auction venue and expelled from future sales.
